Has anybody received an Email from Settlement Administrator with subject Important Legal Notice of Settlement?
It begins,
If You Purchased or Paid for a Prescription Drug with Insurance At Walgreens, A Class Action Settlement Could Affect You.
A federal court authorized this Notice. This is not a solicitation from a lawyer.
A proposed Settlement has been reached in a class action lawsuit against Defendant Walgreen Co. (“Walgreens”) on behalf of individuals, health insurers, and other entities who pay for prescription drugs regarding Walgreens’ usual and customary pricing practices. The class action lawsuit, Russo, et al. v. Walgreen Co., No. 1:17-cv-02246 (N.D. Ill.), relates to how Walgreens determined its usual and customary prices in submitting claims for prescription reimbursement, including whether it should have considered its Prescription Savings Club (“PSC”) prices in determining its usual and customary prices. Walgreens denies any wrongdoing and maintains that it correctly reported its retail prices as its usual and customary prices. The Court has not decided who is right.
The Court has preliminarily approved the proposed Settlement. To resolve the claims, the proposed Settlement will provide for $100,000,000 to be paid by Walgreens (“Settlement Fund”). As discussed below, all Court-approved attorneys’ fees and expenses, the costs of notice and administering the Settlement, service awards, and other costs will be deducted from this amount (“Net Settlement Fund”). The Net Settlement Fund will be paid to members of the Settlement Class (defined below) who submit valid claims.

Searching the Internet (at a high level) it appears to me to be legit.

I just received that email this morning. I actually logged into this board today to see if anyone else had and if it was legit.

Yes, I received it too. My question, if anyone knows: The letter asks for documentation if your estimated OOP expense between 2007 and 2024 is over $10,000. I've been filling my Rx at Walgreens since forever. So, yes, I estimate my OOP over the last 17 years is more then $10,000. But who the heck keeps records that far back?? One place who should have them: Walgreens! I can and will contact Walgreens for a copy of my Rx history for the last 10 years. (Walgreens says 10 yr history is the lmit). Wondering what other people are doing? Why are they just getting the records from Walgreens themselves!??

HIPAA laws protect prescription records as protected health information (PHI). I think you would have to sign a release of information form to give permission for the legal team to access them.

I got the email as well.
I was able to get data out of Quicken going back to 2007, filtered for Walgreens as the payee and categorized as prescription drugs. The amount was just over $10k. But I don't have documentation that far back, so when I filed my claim I clicked the button for between $9999 and I think it was $5k.
It's not like people filing claims will see much money. The fund is $100 million - 80 percent will go to third-party payers, and 20 percent will go to individuals. Of course, attorney's fees and other costs will eat into the settlement fund, so it will actually be less than $20 million to split among individual claimants. Maybe I'll be able to buy a pizza...
