HSA Contributions

Question about HSA and contributions.

My wife's company will contribute $1650/$3300 towards single/family HSA plans. My company will pay $500/$1000 for single/family.

Would it be legal to do the following:

Wife receive HDHP coverage from her job for herself and our child under a family plan, and contribute (employer & personal contribution) up to the family max of $6450.
I receive HDHP coverage for just myself and contribute (employer & personal contribution) up to the single maximum of $3,250.

Thanks in advance; just recently discovered the Boglehead forum and truly appreciate all the helpful advice.

Read "Rules for married people" on p. 6: http://www.irs.gov/pub/irs-pdf/p969.pdf

Rules for married people. If either spouse has family
HDHP coverage, both spouses are treated as having
family HDHP coverage. If each spouse has family coverage
under a separate plan, the contribution limit for 2012
is $6,250. You must reduce the limit on contributions, before
taking into account any additional contributions, by
the amount contributed to both spouse's Archer MSAs. After
that reduction, the contribution limit is split equally between
the spouses unless you agree on a different division.


I decided to include the first paragraph of that section.
52% TSM, 23% TISM, 24.5% TBM, 0.5% cash
