Re: Non-vested RSUs in Divorce?

Thanks to all responses!

MikeG62 & Smitcat, thanks for the Hildebrandlaw link. Before my post, I went there but didn't delve into the details. It still communicates shades of grey with no clear cut answer.

Where it gets murky is the AZ is "community property" state meaning that everything gets split in half regardless of what was brought to the marriage. The stock incentive topic is tricky. My wife and I just want a smooth transition for the rest of our lives.

From all the feedback, it may be more complicated than I thought. Reaching out to an attorney tomorrow. I'll post my findings to the group. Again, thank you for your time and consideration!

Non-vested RSUs in Divorce?

Hello All,
My wife and I have decided to amicably get a divorce. We live in Arizona where it is a "community property" state.

That being said, how are ISO, RSUs and stock options divided? Especially when some might not vest for 2-3 years.

Of course we're going to speak to an attorney, but would like to tap into the Boglehead "brain trust"!
Thanks! 8-)

Re: Father's Trust: Simplify Morgan Stanley Portfolio?

Hey All... RetiredAL: You and your Dad should seriously consider making you the Trustee. If my 95 year old Dad had not made me the Trustee several years ago for his convince, when his health suddenly declined 18 months ago, I would have had to step in at that point. Already having me the Trustee during a very stressful transition in his life, was a major hassle we were able to skip. Also any accounts not in the Trust, such as Banking and Savings, need you at a minimum as agent. My Dad chose to have me as joint on those accounts. Great point. I didn't think about that. Do I become one of the trustees along with my dad or do I become the sole trustee? @afan: Yep, already discussed the process with Fidelity. Nestegg_User: you should obviously ...

Hey everyone, thanks for getting back to me. retired@50: Are you looking to just simplify the holdings and keep the account at Morgan Stanley? Or, do you want to move the account away from Morgan Stanley, then simplify? 1) get out of the individual stocks and simplify. Father's Trust: Simplify Morgan Stanley Portfolio?

My father is 94 yo. He has everything in a Living Trust where I am the successor trustee. 2/3s for his money (~ $500 k) is in a stock portfolio managed by Morgan Stanley. It is a combination of Stocks, Bonds & Mutual funds.

Between mediocre performance, high expenses and fees, I would like to get him into a simple 2 fund portfolio of VXAIX & FXNAX.

Question:
1. How to do it with a living trust?
2. What impact will it be with capital gains and his taxes for 2020?
3. Would it be better if I just left it alone?

The only true reason I use Quicken is for the register with my checking account. I can very easily project all my expenses 2 months out so I'm always in touch with my cash flow in real time. Between recurring payments and ad hoc expenses, I can easily navigate my financial journey. I just spent $41 for the subscription (just for this feature).

If I could do this without Quicken, I surely would!

Re: car maintenance in these times

I'm not filling my tank completely anymore, even with the lower gas prices. Since I'm rarely using my car, I don't want to have a full tank of gas get too old. Also, the gas at your gas station might not be as fresh as it used to be when they would replenish it more frequently. I drive it once a week just so I remember how to drive! LOL

If your tank is going to have gas for more than a month, you might want to consider using Sta-bil...it's not just for your lawn mower. I used to use it with my 1983 280ZX 8-)

I've been with Geico for 8 years. I got a new car and wanted Progressive to give me a quote for a multi car/homeowners/umbrella.
  • Auto quote was lower but I had to have a device in my car to monitor my driving for 6 months. Still considering.
  • More concerning was my home owners...they gave me a much lower quote than my current Home Owners and they valued my property MUCH lower. That made me stop pursuing. The last thing I want to do is pay lower premiums and then find out I'm under-covered. I actually posted this issue but didn't get very good responses.

How much homeowners coverage?

Hi All..I have been covered by by Geico for auto, umbrella and homeowners insurance for 5 years. I connected with Progressive to give me a quote trying to compare apples to apples. They came back with a homeowners quote that was much lower than my current policy. When I looked at their details, their values for replacement and other line items were lower and different. So here is my question:

How do I know if I was over covered with Geico or under protected with Progressive? I don't want to be cheap and then get screwed if something catastrophic happens. At the same time I don't want to pay for over protection either. :?

Olemiss540 » You can sell all of the losers or ones with minimal capital gains ASAP while they are at MS, to minimize potential cost basis paperwork errors on the transfer (have seen these are common). Once you liquidate everything except the highest taxable gains, move the cash out of one account and into a low cost index fund (Fido, Schwab, Vangaurd) and then sell the remaining individual stocks as opportunities present themselves (high TLH opportunities that can offset gains). Most around here are more intelligent on these particular items so please wait for other replys! Just read these are inherited, so they should have very low capital gains since the basis has reset. The big initial problem is going to be to determine how much it will cost to sell each position. I'd look for a broker who offers free trades. This will allow you to sell for free and then buy an appropriate ETF that can be easily moved. Of course, once moved, you'll want to sell in a way to minimize taxes, which others here can help with.
You mean I can actually transfer the stocks out of MS to another broker, pay transfer fees and then liquidate at low/no commission?

Re: Get out of Morgan Stanley!

Thanks for the quick replies!

I already have my personal portfolio split between Fid & Vanguard in index funds and will retire in a couple of years. I've never traded stocks/bonds and I know my dad was being killed with fees, commission and a broker who would suggest too often to move things around and of course, my dad followed her advice and wham...more commissions.

For example, do I close account all at once? Do I pay commissions on each stock to liquidate or is a transaction selling multiple stocks at one time.

Here is his breakdown:
Stocks: 5
ETF: 12 mutual funds

That's the kind of advice I'm looking for.

His trust has a value of around $1.5M, all is in taxed accounts with no tax advantaged or ROTH. He has a very eclectic portfolio in which a majority of his portfolio is in bank CDs and about half is in Morgan Stanley. He has no AA so I have no idea where he is nor how his portfolio is performing. About $600,000 is in Morgan Stanley which is comprised of mutual funds, some individual stocks and ETFs to the likes of Pimco, Nuveen and other sector funds. And, as you can imagine, fees through the roof. My first thought is to consolidate and get out of everything in Morgan Stanly and put it in some index funds. With...

Re-balance to bond and/or cash?

Hello Everyone!

I'm married, 63 yo and plan to work for 3 more years.

Portfolio: $950,000
3 Fund Portfolio (AA 60/40)
1) VTSAX Total Market
2) VTIAX Total Intl
3) FSITX Total Bond

I need to rebalance about $40,000 to $50,000. This would normally be a no brainer...take from equity, move to bond, and stay the course. However, with such growth in the market, I'm torn because I would like to capture some of that profit and protect it.

Does it make sense to re-balance 100% to cash instead of bond? ...or 50% to cash wait for a dip in the market to reinvest? Or, put the funds in a CD?
Thanks in advance for your suggestions! 8-)

How to pay for prep for house sale?

Hi All, I plan on "re-birthing" next year. Also, my wife and I plan to sell our house early next year so we need to do some flooring, painting, repairing etc. to get the house presentable to sell. My question is...What do we use to pay for the tasks needed to sell? I'm guessing I'll need about $10,000 to $15,000. We're currently contributing to the max for 401k ($24K/each) I don't want to stop our current contributions that because of the income tax help it provides. So here are my other options: > Loan? > 401K withdrawal? > Roth withdrawal? > New credit card w/0% interest for 1 year? > Combination of some? Our Portfolio Percent Breakdown: 401k: 69% Roth: 31% Do you have some suggestions? Thanks in advance! 8-)

Re: The 60/40 stock-and-bond portfolio mix is dead in 2016?

Thank you all for your insight and perspective. What I took from the article is that when you retire at age 65-ish, it's not the end of the road and you then go to 100% cash. You need to maintain that portfolio "growth engine" and keep nurturing it because you will probably need more $$$ long after you retire. From that perspective, is 60% too much or 75% too little?

The question is how much additional accumulation, based on risk, should you allow yourself to have near or after you retire?

As for the bond discussion, I don't own bonds to reap more % growth. I want it to dampen the ebb and flow of the market.

Again, thanks for all your insight! 8-)

I would be impressed if one is able to cut cable and internet, because most people are essentially replacing cable with high-speed internet.
The difference is the internet gives you interactive access to the outside world for work, play, knowledge, information and pleasure. Cable TV by itself is "57 channels and nothing on". Ultimately, what's happening is the internet rates are going up-up-up! and soon, Federal gov will be regulating and controlling it

Re: At what age did you find dream job?

I was in my "degree" career for 15 years (marketing communication) and HATED it. I was unemployed and found myself playing with a computer that I purchased to do my resume. One day while I was explaining something to a buddy, he commented that I should be a computer trainer. That was back in 1994 when I was 40 years old and re-careered and started training Word Perfect 5.1.(LOL) 20 years later, I'm manager of training for a large Physician group (teaching doctors how to use computers in the exam room) and still having the time of my life! Yes, this is my dream job...and I just fell into it 8-)

Re: Combine Roth IRA's

I'm 60 and my wife is 53. I have access to my portion of my Roth NOW if we need the money for something. Even if it has to sit in there for 5 years, I'll still have access to it before she will. We use her Roth as "spill over". The Admiral shares issue is another good reason.
