Thank you for digging into the plan documents and finding this language. It's good to know that I could do a workaround by first rolling the Traditional IRA into a Solo 401(k) with a different provider, and then rolling back to Fidelity. Although I'm not sure it's worth the hassle right now just for the backdoor Roth.

I clarified with the person on the phone that this was all pre-tax contributions. They said because it was not a Rollover IRAs, but a Traditional IRA that contained funds from multiple sources, they consider it commingled and I can't roll it over to the Solo 401(k).

Perhaps it's because they can't really prove that the funds don't include pre-tax, and don't have visibility into the history of the account. FWIW this is an IRA that I transferred to Fidelity from Betterment. I had rolled 3 different 401(k)s into it when it was at Betterment.

Update: I just called Fidelity and they told me that I can't rollover my Traditional IRA into a Solo 401(k) because it has commingled assets. This IRA contains assets from multiple 401(k) rollovers. I wish I would known to keep my Rollover IRAs separate.

Am I correct in thinking that I'm basically out of luck and there's no good way for me to configure my accounts to allow for a backdoor Roth IRA contribution without pro rata? Or do other Solo 401(k) providers allow for bringing in commingled funds?

Would it be possible for me to do all of this for tax year 2022? It seems like there might be time to get the accounts opened and transferred before the tax filing deadline. Or does the solo 401(k) have to be established within the calendar year in order for me to make a 2022 “employer” contribution into it?

I assume you read this ProPublica article where they talk about Goldman Sachs doing that kind of tax loss harvesting between stock classes. I have a sole proprietorship side hustle and have been contributing to a SEP IRA for the last few years. I chose the SEP over the Solo 401(k) because I have access to a good 401(k) plan through my W2 job and prefer to make my "employee" contributions there. It seemed like the SEP was the better choice, since I was only planning to make self-employed "employer" contributions and it was easier to set up. I also have a Traditional IRA — I made pre-tax contributions before I hit the income limit and have rolled various 401(k)s from previous employers. I realize now that an additional advantage to the Solo 401(k) is that it could allow me to rollover my pre-tax IRA accounts into the Solo 401(k), enabling future backdoor Roth ...

We're in the MFJ 32% tax bracket and any significant surrender would push into 35%. We don't anticipate being in a lower bracket for the medium-term.

I need help thinking through a whole life policy with a significant policy loan. My wife received this policy as a gift from her grandfather when she was 13 years old, in 1985.
