Re: Penna. executor's fees for handling will?

The estate can also get a small discount on the inheritance tax by paying most of it (by making a reasonable estimate) within a certain number of months (nine?) of the date of death. In Pennsylvania, inheritance tax payments are due upon the death of the decedent and become delinquent nine months after the individual's death. If inheritance tax is paid within three months of the decedent's death, a 5 percent discount is allowed. So for the 5% discount you just need to make an estimated inheritance tax payment in the first 3 months after death. Have 9 months to file the actual inheritance tax return. Is that common? I've only had about a half dozen Pennsylvania estates (either Pennsylvania residents or persons elsewhere who had real estate ...

Re: Penna. executor's fees for handling will?

Thanks for the replies. The estate is about $1M and he's saying 200K of that is going to fees which he listed as inheritance tax (4.5% so that's 45K), lawyer's fee, misc. fees like public notice fee, and his executor's fee. For that to be 200K sounds awfully excessive to me, esp based on what I'm hearing and reading. I hesitate to ask for a breakdown as frankly he's copped an attitude about the whole thing and has serious anger management issues in general, but if push comes to shove, I might...not because I care about the money per se, but I do about him and/or the lawyer (or someone else perhaps, though I can't imagine who) screwing the rest of the family (the estate is to be divided equally among all siblings). There are no income tax c...

Re: Tales from this insane real estate market [Home sales]

In my area, a little north of Tampa, more and more homes are going up for sale and staying for sale for months. Prices have come down and we are in the process of buying, closing is in a few weeks. We actually successfully negotiated a lower price. I have seen this as well, in my target market in N.E. Florida. I have noticed condos dropping in price somewhat. SFH's, too, but not as much as condos. It is becoming increasingly affordable for me. I think it's the HOA/Insurance crisis affecting home prices in the N.E. Florida market. I also see this trend in SW Florida. Prices are still high but I'm seeing more new listings many old listings with price reductions. I agree that some of this trend due to greatly increased price of insurance. It'...

Large banks keep deposit rates low bc the average customer is reluctant to leave. And local banks have dismal deposit rates also. I only use one local larger bank for a no fee checking account.

I've long abandoned larger and local banks. For my CDs the best rates I've found is with credit unions. I've spread the CDs with three credit unions. And I use VG Treasury Fund as a great place to park funds till invested elsewhere.

It's a crazy system and it's embarrassing to be part of it sometimes. But I'd invite anyone who thinks $2K is an outrageous price to pay for an ED visit, any ED visit, to go open their own ED and put that expensive one out of business. Good luck! I think that's exactly what "Urgent Care" companies are trying to do. Well, maybe not put ERs out of business, but skim the easy cream off the top. I wonder if there are any stats regarding the income level and insurance type of folks who use the UC versus ER. I know if it was something minor, I'd stay far, far away from the ER. If Urgent Care is skimming off well insured patients from their ER why doesn't hospitals adjust their plan. Such as hospitals should offer 24 hour Urgent Care ri...

You can check discounts on their website link. If I'm not allowed to post this link mods plz remove it.

Re: Giving (unequal) money to adult children

Some good insight in this thread in regards to estate planning. Relevant as my Mom just asked me to be her executor (she's 70). Lucky (unlucky?) she doesn't have much of an estate. Other than her house which is on a prime piece of real estate gifted to her from her Dad 40 years ago. Its the house we all grew up at and still go over all the time. Has a pond, woods and next to a large county nature park so just pure nature bliss. Pretty much all of us and our children (her grandkids) love it. Here's the kicker, she has 12 kids and we all still live in our hometown. Plus 40 grandchildren. No way, we are going to let it out of the family. But who ends up with it? Probably only 3 of us could afford to buy it at its current market price (probabl...

I had a similar question to the OP. I'm 64. I've checked optimal SS claiming dates with Open Social Security several times over the past 5 years. It's always recommended a date right before I turn 70.

Tried it again recently and it recommends starting SS a few months after I turn 65. Changing interest rates can cause this much of a difference?

Over the past 5 years the hospital I work at lost several physicians to the VA. Mostly specialists (a few surgeons, pulmonologist, nephrologist) made the switch. All were over 60 years old and wanted a better work/life balance.

They are all still at the VA and I understand they are happy they made the switch. The disadvantage is they accepted a lower salary but the benefits of a reduced workload and better work/life balance was what they were looking for.

(I am single with one minor child and both of my parents are deceased). What is the best way for my sister to have immediate access to, say, $5,000.00? So they fix a few and hope for more funds next year. How do they choose which roads to fix? Seems they fix the main roads first as they have much more traffic than seldom used roads.

You could do a rollover to 529 for grandchildren and pay no income taxes. For 2024, the interest exclusion is $145,200 if married filing jointly. When a savings bond is redeemed, the interest counts as income for the purpose of the income phase-out. So, you may need to use or rollover the savings bonds over several years to avoid triggering the income phase-outs. If AGI is $90k per year for MFJ, you could do $65k per year and spread it out over several years. In order to qualify for the tax-free use of Savings Bonds, the grandchild must be a dependent. Unless the grandchild is claimed as a dependent on one's income tax, the contribution to a 529 Plan does not qualify for the tax-free exclusion. Thanks Mel, for the clarification. We do not ...

Why is a lawyer doing the PA state tax? Unless the estate is super complicated, you can just have a CPA do it.
There is no trust. 1099 is for interest for the calendar year. My father's bank accounts all had POD beneficiaries. So the money stayed in his account till we went to the bank to claim it.

Filing taxes in the year a person dies

My Dad passed in beginning of August 2023. I'm might try to do his personal Federal and State taxes if not too complicated. Lawyer is handling Pennsylvania estate tax.

My question is regarding 1099's. Say if he receives a 1099 with bank interest of $10K. Is that amount prorated so 7 months goes on his personal return and 5 months on inheritance return?

I ran this by an accountant and he said the full $10k should be reported on his personal tax or the IRS will question why it doesn't match the 1099.

Since lawyer is doing inheritance tax due from date of death seems like he's paying extra taxes.

There are various bonds that sound like they involve the government, but only some of them are exempt from state and local income tax. You need to consult the document that Vanguard issues every tax season to see how much of the dividend income is exempt. Also you need to make sure that certain other criteria are met, if you live in certain states. (See the footnotes in that document.) Last year the Federal MMF was only 37.79% exempt, but some states disallowed taking any exemption. Usually the Treasury MMF is entirely exempt from state and local tax; however, this year during uncertainty over the debt limit, it held a lot of repurchase agreements (which don't have that state-tax advantage) instead of Treasurys only. These data are in that...

Re: Will related issue

Sure I'll be your long distance executor! Maybe not so much distance, I'm from Pa also. I was lucky she returned it. I had a copy of will that I was prepared to submit but I'm sure that would be much harder for success.

I'm still leary about giving the will to sisters lawyer. Just don't trust anyone to secure this document. Think I'll see my lawyer and see what she recommends. Thing is I want to talk to sisters lawyer to explain things. But I always remember her lawyer doesn't represent me.

Re: Will related issue

From the Montgomery County (Pa) Register of Wills. "No. The law does not require eyewitnesses (subscribing witnesses) to the signature of the testator in order for the will to be valid. However, it is the custom to have two subscribing witnesses present ...." I'm pretty sure my father's will didn't have any witnesses and it was fine when he passed last year. He lived in Pa. Francis What is status of the will? Have asked sister to return it? Have you spoken to anyone? 1. Superficially will appears likely valid. But certainly still a question 2. Deceased appears to have assets beyond those with POD/TOD including real property. Likely there needs to be probate. Whether small estate or full probate not known. 3. Sister posses will or...

Re: Will related issue

What can it hurt for OP to contact the no-kill shelter especially as it appears from my reading that it might be a substantial amount. OP do you have any idea what amount we are speaking of and could you relay that to the charity? They may or may not get back to you but I see no harm in contacting them. Of course, none of this matters if it is not deemed a legally executed will. OP should be able at this point to make a decent assessment of whether the basic guidelines were followed. I can't estimate how much would be going to the charity for the following reason. I don't know if she has POD an all of her financial accounts or just a few. Same with her house. I think the will is fairly well constructed. The will is handwritten, signed and ...

Re: Will related issue

Person A passed away recently. Person A previously gave me her handwritten will. Person B, sibling of A, contacted a lawyer. I met with B and presented her the will for the lawyer. B accepted the will. B then stated she already met with lawyer, told him no will was found, and is going to leave it like that. I fear the will may be discarded. I have printed and digital photos of the will (but not the original). Any thoughts how to handle this? Plz concentrate on the legal aspects as relationship issues are off topic. Thanks. Francis Person A gave you a will, that was omitting person B (her sister). And you chose to give the will to Person B. Why? Person B made contact with a lawyer and will be executor. Not exactly accurate sister will get n...

Re: Will related issue

The will did not name an executor. I guess I should have said almost everything to the shelter. I would be inheriting a property.

I have no idea why the sister is in line to be executor. Maybe it's bc she approached the lawyer? Maybe bc she's the last immediate family member?

Re: Replacing tail light bulb

Wanted to report back. Replaced brake light bulb today. YouTube vids helped. Pretty easy to do. 10 minutes tops. Hardest part was sliding out the taillight assembly and the bulb was very tight. Mission accomplished.

Re: Will related issue

OP, In FL a will is not even valid if it is not signed by two witnesses. Don’t know what PA stipulates. But you can see there are many issues here. One thing I would ask: is the sister named as a beneficiary? Will has lot of charitable grants. The sister is not a will beneficiary. But she is on some POD accounts. Those POD designations are from a long time ago. Person that passed never got around to changing them. If the will isn't "found" I would think sister would benefit greatly. Francis Hence the “missing “ will… The only thing that I’m sure you’re aware of is if you press the issue by countering her claim by providing her lawyer with your copy is how deeply do you want to get involved in this if you are not part of the will....

Re: Will related issue

OP, I am trying to understand the details here. The deceased person had TOD/POD designation as the sister B. Those assets will go to her since the deceased never updated those regardless of the will. There is no point in putting a fight over these. You will and the "will" will lose. Now to the pertinent question, for the assets that do not have a beneficiary designated, and are supposed to go to charities as per the will - are these being claimed by the sister? If so, just contact the sister's attorney. If they are not responding, simply contact the charities and let them handle it. As for you, please just stay out of it. I am saying this kindly. There is nothing to be gained by confronting the sister. Understand the POD's are so...
