There is legislation in the works that attempts to compel providers to accept in-network fees for emergencies. This situation is the very reason that surgeons do not want to be on-call. Thanks for the replies. I have found language in our service plan indicating that emergency care is covered, even if the physician is out-of-network. Hopefully, this will simply be an issue of convincing the carrier that treatment provided was in fact an emergency.
